Supreme Court approves third-country deportations

Donald Trump is on a mission to remove all nefarious actors from this country who entered it illegally, even if he has to send them somewhere other than their native countries.  

When Trump initiated the program, Democrats and liberal activist organizations immediately litigated the matter.  

While Trump had been defeated in the lower courts, the Supreme Court just delivered a crushing blow to leftists.  

Trump's earlier defeat 

Trump was having challenges deporting some of the criminal illegal immigrants, as their native countries wanted no part of them.  

So, Trump worked a deal with several other nations to take these migrants, such as Libya and El Salvador.  

That plan was halted, however, after being challenged in the lower courts.  

Trump also lost an appeal on the First Circuit in May.  

Take it to the Supreme Court 

After losing the appeal, the Trump administration filed with the Supreme Court to have the case heard to allow the third-country deportation.  

The DOJ argued, "The United States is facing a crisis of illegal immigration, in no small part because many aliens most deserving of removal are often the hardest to remove.” 

This was a huge test for both the administration and the Court when you consider how many cases are currently pending regarding Trump’s immigration agenda.  

If he were to lose this case, it would not only be a crippling blow to the administration, but also result in possible lawsuits against the country, hitting taxpayers with another large legal bill.  

Supreme Court rules 

This week, the Supreme Court ruled along ideological lines to stay the appeals court ruling. 

Justice Sonia Sotomayor penned the dissent for the three liberal justices, stating, "Rather than allowing our lower court colleagues to man­age this high-stakes litigation with the care and attention it plainly requires, this Court now intervenes to grant the Government emergency relief from an order it has repeat­edly defied. I cannot join so gross an abuse of the Court’s equitable discretion.” 

As I noted above, the Trump administration currently has cases stacked up regarding the immigration agenda, so this ruling is a big win for Trump and hopefully a sign of things to come in future cases.  

Keep in mind, however, due process arguments are still in play, so while Trump can use third-country deportations, they will still take place at a snail’s pace unless Congress can get legislation passed to speed up the process, but that is unlikely since the GOP does not have 60 seats in the Senate.
